Vendetta Survey Drawing Rules
NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
1) ELIGIBILITY: Contest is offered and open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older. Persons under the age of 18, or those who reside in countries other than the United States, or those who reside in Puerto Rico or other U.S. territories, commonwealths, or possessions are not eligible to participate in this contest. All entries received from persons under the age of 18, or from persons who reside in countries other than the United States, or those who reside in Puerto Rico or other U.S. territories, commonwealths, or possessions, shall be void. Employees of the McLaughlin Gormley King Company, and its affiliates, subsidiaries, and any related companies (“Sponsor”), along with the immediate families and household members of such employees (including spouses, parents, siblings and children, and each of their respective spouses regardless of residence) are not eligible to participate. Void where prohibited.
2) HOW TO ENTER: Contest begins at 8:00 am Central Time on May 17th and ends at 4:00 pm Central Time on June 6th, 2007 (the “Entry Period”). All participants may enter by completing the entry form for this contest available via mail or by completing the Vendetta Survey on Zoomerang.com. Only one entry per person/email address is permitted. Multiple entries received, whether created by robotic, automatic, programmed or similar entry methods that generate more than one entry per person/email address, or otherwise, are void. Entries may be subject to verification prior to prize drawing. All entries become the property of Sponsor and will not be returned or acknowledged.
3) PRIZE: One prize equal to $100 US will be awarded for a total of one (1) prize. Federal, state, and local taxes on the prize are the sole responsibility of the winner.
4) PRIZE DRAWING: The winner will be selected at a random drawing, to be conducted at Sponsor’s offices on June 11th, 2010. All eligible entries received during the Entry Period will be included; all other entries are void. The odds of winning will depend on the total number of eligible entries received. By acceptance of the prize, the winner consents to Sponsor’s use of winner’s name, photograph, or other likeness for purposes of advertising, trade, and promotion on behalf of Sponsor without further compensation unless prohibited by law.
5) NOTIFICATION OF WINNER: the Winner will be notified after June 14th, 20010 by telephone, e-mail (if applicable) or U.S. mail, at Sponsor’s sole discretion. If a potential winner cannot be reached within ten (10) calendar days from the first notification attempt, then such person shall be disqualified and an alternate winner will be selected through a random drawing from the same group of entries from which the original winner was picked. Sponsor is not responsible for providing any winner with notification of his or her winning entry by email if (i) its email attempts are blocked by spam filters; or (ii) a winner provides an inaccurate email address. Sponsor is not responsible for providing any winner with notification of his or her win by U.S. mail if the mailing address provided is inaccurate. Winners may be required to complete, sign, have notarized and return Affidavits of Eligibility, Liability Releases, and (where permitted) Publicity Releases within fourteen (14) days of date of notification. If not timely returned or if any prize notification or prize is returned as undeliverable, that prize will be forfeited and awarded to an alternate winner.
6) ADDITIONAL TERMS: By entering the contest, participants agree to (a) abide by these Official Rules, the results of the random drawings and the decisions of Sponsor, which shall be final; and (b) release, discharge, and hold harmless Sponsor; its respective advertising and promotion agencies, telephone network or service providers, and its employees, directors and officers (collectively “Releasees”), from and against any/all liability, claims, losses, injuries or damages, including death, resulting from the acceptance, use or misuse of any prize and/or participation in the contest. Contest is governed by laws of the State of Minnesota, and all participants hereby consent to the mandatory jurisdiction of the state courts of or federal courts in the State of Minnesota for the resolution of all claims and disputes concerning this contest.
7) LIMITATIONS OF LIABILITY: Sponsor and its agents are not responsible for any late, lost, illegible, incomplete or misdirected or otherwise deficient entries, nor for incorrect or inaccurate information. Sponsor assumes no responsibility for any technical or human error that may occur in the mailing or processing of submissions that may limit, delay, or prevent a participant’s ability to participate in this contest.
If, for any reason, the contest cannot be conducted as planned by reason of tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this contest, the Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this contest or the drawing and may conduct a drawing and select the winner from among all eligible entries received prior to the action taken.
In no event will Sponsor and/or Releasees be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of the completion of or transmission of a contest entry. Some jurisdictions may not allow limitations or the exclusions of liability for incidental or consequential damages, or exclusion of implied warranties, so some of the aforementioned limitations or exclusions may not apply. Check local laws for any restrictions or conditions regarding these limitations and/or exclusions.
8) MAILING LIST REMOVAL: To be removed from any mailing lists resulting from the contest write to: Attn: Vendetta Survey Drawing c/o McLaughlin Gormley King Company, 8810 10th Avenue North, Golden Valley, MN 55427 or brands@mgk.com.
9) WINNER’S LIST: For the name of the contest winner, available after June 14th, 2010, mail a self-addressed, stamped envelope to be received by May 31st, 2007 to: Vendetta Survey Drawing, c/o McLaughlin Gormley King Company, 8810 10th Avenue North, Golden Valley, Minnesota 55427. By accepting any prize awarded under this contest, the winner consents to the disclosure of the foregoing information to the public.
